Terms and Conditions

These Terms and Conditions ("Agreement") govern your access to and participation in courses and other activities ("Course") provided by Expedition Ready ("Company," "we," or "us"). By purchasing, accessing, or using our Course, you agree to be bound by these Terms and Conditions. Please read them carefully before enrolling.
1. Definitions and Interpretations
- "Provider" refers to Expedition Ready, the entity offering the Course.
- "Participant" refers to the individual or entity enrolling in and participating in the Course.
- "Course" refers to any and all courses provided by the Company.
- "Materials" refers to any content, documentation, videos, and resources provided as part of the Course.
2. Course Access and Use
- License Grant: Upon payment and enrollment, Participants are granted a non-transferable, non-exclusive, limited license to access and view the Course Materials solely for personal and educational purposes.
- Restrictions: Participants may not copy, reproduce, distribute, or otherwise use the Course Materials for commercial purposes or share them with third parties without explicit permission from the Company.
3. Payment Terms
- Pricing: Course fees are in USD, exclusive of any applicable taxes. The Company reserves the right to modify the price of the Course at any time.
- Payment Schedule: Payment must be completed before gaining access to the Course. The Company accepts payments via Thinkific Payments and all that encompasses.
- Refund Policy: The Course fee is non-refundable once access to the Course has been granted, except in cases where the Course is not as described or the Company fails to deliver the agreed-upon services.
4. Intellectual Property Rights
- Ownership: All intellectual property rights in the Course, including but not limited to text, images, videos, and course materials, are owned by the Company or its licensors.
- Usage Rights: Participants are granted limited rights to access and use the Course for personal educational purposes. All rights not expressly granted herein are reserved by the Company.
5. Participant Obligations
- Conduct: Participants agree to engage in the Course in a respectful and professional manner, refraining from disruptive behavior. The Company reserves the right to remove any Participant who violates the terms of conduct.
- Compliance: Participants agree to comply with all applicable laws, regulations, and guidelines while participating in the Course.
6. Limitation of Liability
- General Limitation: To the fullest extent permitted by law, the Company, its employees, agents, partners, and affiliates shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or in connection with the Course, including but not limited to injury, death, or damage to property.
- Risk Acknowledgment: Participants acknowledge that they are participating in the Course voluntarily and accept the inherent risks associated with outdoor activities.
7. Indemnification
Participants agree to indemnify and hold harmless the Company, its employees, agents, affiliates, and business partners from any claims, damages, or liabilities arising out of their participation in the Course, including any third-party claims.
8. Privacy and Data Protection
- Data Collection: The Company may collect personal data from Participants, including but not limited to names, contact information, and payment details, for the purpose of providing access to the Course.
- Data Usage: The Company will use personal data only for the administration of the Course and may contact Participants with Course-related communications. The Company will not share or sell Participant data to third parties unless required by law.
- Security: The Company employs reasonable security measures to protect personal data but cannot guarantee absolute security.
9. Termination Clause
- Termination by Participant: Participants may terminate their enrollment by contacting the Company, though refunds will not be issued once the Course has been accessed.
- Termination by Company: The Company reserves the right to terminate the Participant’s access to the Course if these Terms and Conditions are violated. In such cases, no refund will be issued.
10. Governing Law and Dispute Resolution
- Jurisdiction: This Agreement is governed by and construed in accordance with the laws of [Province], Canada.
- Dispute Resolution: Any disputes arising out of or in connection with this Agreement will be resolved through binding arbitration in Nova Scotia, Canada, in accordance with Canadian Law.
11. Liability Waiver
By enrolling in the Course, Participants acknowledge and accept that they are voluntarily participating in outdoor activities that involve inherent risks. The Company is not liable for any injury, loss, or damage that occurs during the Course. Participants agree to release and hold harmless the Company from all claims, including those arising from negligence.
12. Miscellaneous
- Force Majeure: The Company shall not be liable for any failure to perform due to unforeseen circumstances or causes beyond its control.
- Severability: If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Entire Agreement: These Terms and Conditions constitute the entire agreement between the Company and the Participant regarding the Course.
By enrolling in and accessing the Course, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
